Liability Waiver and Release of Claims
I acknowledge that I derive personal satisfaction and benefit from my participation and/or my child’s participation with Innoaddi (“Innoaddi”), and I willingly engage in Innoaddi classes, events, and other activities (the “Activity”).
Release and Waiver
I HEREBY RELEASE, WAIVE, AND FOREVER DISCHARGE ANY AND ALL LIABILITY, CLAIMS, AND DEMANDS OF WHATEVER KIND OR NATURE AGAINST INNOADDI AND ITS AFFILIATED PARTNERS AND SPONSORS, INCLUDING, WITHOUT LIMITATION, THEIR DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS (THE “RELEASED PARTIES”), TO THE FULLEST EXTENT PERMITTED BY LAW. THIS INCLUDES, BUT IS NOT LIMITED TO, DAMAGES OR LOSSES CAUSED BY THE NEGLIGENCE, FAULT, OR CONDUCT OF ANY KIND ON THE PART OF THE RELEASED PARTIES, INCLUDING DEATH, BODILY INJURY, ILLNESS, ECONOMIC LOSS, OUT-OF-POCKET EXPENSES, OR LOSS OR DAMAGE TO PROPERTY, WHICH I, MY HEIRS, ASSIGNEES, NEXT OF KIN, AND/OR LEGALLY APPOINTED OR DESIGNATED REPRESENTATIVES MAY HAVE OR WHICH MAY HEREAFTER ACCRUE ON MY BEHALF, ARISING FROM MY OR MY CHILD’S PARTICIPATION IN THE ACTIVITY.
Assumption of Risk
I acknowledge and understand that:
Participation may include possible exposure to and illness from infectious diseases (including but not limited to COVID-19). While rules and personal discipline may reduce this risk, the risk of serious illness and death does exist.
I knowingly and freely assume all such risks related to illness and infectious diseases, even if arising from the negligence or fault of the Released Parties.
I knowingly assume the risk of injury, harm, and loss associated with the Activity, including any injury, harm, or loss caused by the negligence, fault, or conduct of any kind on the part of the Released Parties.
Medical Acknowledgment and Release
I acknowledge the health risks associated with the Activity, which may include, but are not limited to, transient dizziness, lightheadedness, fainting, nausea, muscle cramping, musculoskeletal injury, joint pain, sprains and strains, or other injuries. I agree that if I or my child experience any symptoms during the Activity, participation will stop immediately and appropriate medical attention will be sought. I HEREBY RELEASE AND FOREVER DISCHARGE THE RELEASED PARTIES FROM ANY CLAIM WHATSOEVER THAT ARISES OR MAY HEREAFTER ARISE ON ACCOUNT OF ANY FIRST AID, TREATMENT, OR SERVICE RENDERED IN CONNECTION WITH MY OR MY CHILD’S PARTICIPATION IN THE ACTIVITY.
As a student, participant, volunteer, or attendee, I recognize that participation, involvement, and/or attendance at any Innoaddi Activity is voluntary and may result in personal injury (including death) and/or property damage. By attending, observing, or participating in the Activity, I acknowledge and assume all risks and dangers associated with participation and/or attendance, and I agree that:
(a) Innoaddi,
(b) the property or site owner of the Activity, and
(c) all past, present, and future affiliates, successors, assigns, employees, volunteers, vendors, partners, directors, and officers of such entities
(collectively, the "Released Parties") will not be responsible for any personal injury (including death), property damage, or other loss suffered as a result of participation in, attendance at, and/or observation of the Activity, regardless of whether such injuries or losses are caused by the negligence of any of the Released Parties (the "Released Claims"). BY ATTENDING AND/OR PARTICIPATING IN THE ACTIVITY, I AM DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY TO THE RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY LAW.
Release of Liability and Indemnity
Innoaddi assumes no responsibility for personal injury or loss or damage to any personal property. I hereby release, discharge, waive, and relinquish, on my behalf and on behalf of my child(ren), any and all claims or actions that any of us may have against Innoaddi, its affiliates, licensees, successors or assigns, and all of their officers, directors, employees, agents, and contractors (the “Released and Indemnified Parties”) arising out of or relating in any way to this agreement, the programs, or the services or equipment provided by Innoaddi.
I agree to defend, indemnify, and hold the Released and Indemnified Parties harmless from and against any and all claims, demands, actions, suits, damages, liabilities, losses, settlements, judgments, costs, and expenses (including reasonable attorney’s fees and costs) arising out of or relating in any way to this agreement, the programs, or the services or equipment provided by Innoaddi.
Liability and Responsibility Agreement
I acknowledge that this Liability and Responsibility Agreement will be used by Innoaddi for the activities in which I, my child(ren), and/or any members of my family may participate, and that it will govern our actions and responsibilities at such activities.
I HEREBY ASSUME ALL OF THE RISKS OF MY, MY CHILD(REN)’S, AND/OR ANY FAMILY MEMBER’S PARTICIPATION IN ANY AND ALL ACTIVITIES HELD BY INNOADDI, including without limitation any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or from their possible liability without fault.
I hereby waive, release, and discharge Innoaddi, its teaching staff, and administrative staff from any and all liabilities and claims in case of accidents, sickness, personal injury, or any loss or damage of personal property to me or any member of my family at any time in the facility or building, or at any other activities sponsored, held, or participated in by Innoaddi. I agree to take full responsibility for the safety of myself and all members of my family while attending Innoaddi activities and using Innoaddi facilities.
I agree to INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO ASSERT CLAIMS AGAINST Innoaddi, its teaching staff, and administrative staff for any and all liabilities or claims made as a result of participation in activities held by Innoaddi, whether caused by the negligence of the Released Parties or otherwise.
I agree to take full responsibility for any damage or loss caused by the student, parent/guardian, or any family member to the facilities used by Innoaddi during the use of such facilities. I agree to ensure that my child(ren) follow and obey Innoaddi rules and regulations during classes, activities, and use of facilities.
This Waiver and Release of Liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
Warning: This agreement is legally binding. By signing it, you give up your right to recover compensation through the courts or otherwise for any personal injury, damage to your property, or for your or your child’s death, whether caused by negligence, accident, or otherwise. Parent/legal guardian signature is required for participants under 18 years old.
